§1 Scope
These Terms and Conditions govern all business relationships between consumers and the Rohner AG that are initiated through the Online Shop.
§2 Minimum Order Value
The minimum order value for the Rohner Online Boutique is CHF 40.00 / EUR 25.00.
§3 Prices
The valid prices for products offered through the Rohner Online Boutique are those displayed immediately prior to submitting the order. Prices include the legally required VAT for Switzerland and Germany.
§4 S&H Charges
Shipments are subject to a S&H fee of CHF 7.00 per order for shipments within Switzerland and EUR 6.00 per order for shipments to Germany. For orders exceeding CHF 200.00 to be shipped to a Swiss address, Rohner will pay for the S&H charges.
§5 Contract
By clicking on the “Submit Order” button that is displayed at the end of the order process, you are making an offer for the conclusion of a purchase agreement with Rohner.
We will confirm receipt of your order on the next screen and via e-mail. Neither, however, constitutes an acceptance of your offer, but only serves to inform you about the receipt of the correct order information.
We will save your order information. If you want to keep a record of your order confirmation, please print out the confirmation page.
Rohner is entitled to reject your order in full or in part due to unexpected delivery problems or a poor credit rating. We will inform you within three business days after having become aware of these kinds of circumstances by sending you an e-mail. We will reimburse any prepayments you have already made for non-delivered merchandise.
The contract between Rohner and you will become valid upon our shipping the ordered merchandise to you. There shall be no valid purchase contract for products from the same order that are not listed in the shipping confirmation.
§6 Shipment
Rohner ships all available merchandise immediately upon receipt of your order. You will receive the merchandise within three to four working days, but at the latest within 7 working days.
Should certain products not be available immediately due to high demand, we will send you an e-mail informing you of the projected ship date.
§7 Payment
The Rohner Online Boutique has the following payment options:
- Credit card: If you would like to pay by credit card, Rohner will charge the payable amounts to your credit card account. As with all private information, your credit card information will be transferred in a secure manner (via SSL).
- Invoice (only in Switzerland): Please pay your invoice within 14 days of receipt of your shipment. Should you not pay within this time period, we will send a first payment reminder and then a demand note.
The delivered merchandise shall remain the property of Rohner AG until it has been paid in full.
§8 Warranty and Damages
Rohner has been renowned for decades for the high quality, reliability and wearing comfort of its products. All merchandise is subjected to several quality controls before leaving our warehouse.
We guarantee the shipped merchandise to be free from defects. The legal warranty provisions apply. Slight product deviations, particularly with regard to color, do not constitute a defect triggering a warranty claim.
We do not issue a standard warranty unless we expressly state so. Rohner is not liable for slightly negligent breaches of duty if they do not relate to damages resulting from an injury to life, body, or health or any issued warranties or relate to claims based on the product liability law. This also applies to breaches of duty by vicarious agents [Erfüllungsgehilfen], if any.
§10 Data Protection and Security
Your personal information and all other order information will be encrypted and transmitted via a secure SSL connection.
We will save your name, address, and order related information. We guarantee a comprehensive protection of your personal information in accordance with the provisions of the data protection law.
Your information will only be forwarded to third parties if this is necessary to fill your order, e.g. for the possibly required credit card, credit rating, or address verification.
We continually strive to improve upon the product offering and the service of the Rohner Online Boutique. To do so, we regularly analyze customer and order information.
§11 Set-off and Assignment
You are only entitled to a set-off, if your counter claims have legally been confirmed or are uncontested.
You may only assign your contractual rights to a third party with our written consent.
§12 Final Provisions
Only Swiss Law applies. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply. The jurisdiction is Balgach.
